Over the last few years, we have seen several rounds of US export controls focused on the semiconductor industry.  These controls have targeted advanced semiconductors, semiconductor manufacturing equipment, and related technology, all for the stated purpose of protecting US national security and keeping sensitive technologies out of the hands of foreign adversaries.

It has not been a linear path. The rules continue to evolve – the AI Diffusion Rule immediately comes to mind – with broad impacts on the Outbound Investment Security Program, the construction and operation of data centers outside the United States, the UAE’s status in the Export Administration Regulations and the CFIUS program, and more.

This discussion will examine the current regulatory framework for the controls in place today, common pain points and tips for working through them, practical implications for companies, and what's on the horizon.  There will be time for Q&A following the discussion.

Speakers:

  • Matt Borman, Senior Counsel, Akin Gump (formerly Deputy Assistant Secretary for Export Administration at the Bureau of Industry and Security in the US Commerce Department)
  • Janet Kim, Partner, Baker McKenzie
